This Authority to Act advises the client of the obligations of the licensed customs brokerage and their own obligations regarding importing goods into Australia.It should be reviewed in conjunction with the customs brokerages terms and conditions as well as legislative requirements as/where applicable. Customs Clearance Authority – I/ We (the Customer) hereby authorize Customs Brokers Pty Ltd ABN, 63 636 237 682 (the Company) its subsidiaries or other business names, and its nominees and/or subagents as may be appointed when required to act as my/our Licensed Customs Broker for the purposes outlined in the Customs Act 1901 section 181. We acknowledge the details below regarding legislative authority, indemnity and trading terms and conditions. Authority for other legislative and related purposes – The Customer authorises the Company to quote the Customs ABN as may be required by the ATO, and other related legislation in respect of the imported goods, or the exported goods to the Australian Border Force, or any other Government Authority. This relates to the actions of clearance, transportation of the goods, and other reporting obligations or goods and services undertaken for the Company. Debt Recovery Costs – The Customer shall be liable to the Company for all costs and expenses incurred in the recovery of any unpaid debt, including but not limited to legal fees, solicitor’s costs on a full indemnity basis, and any fees or commissions payable to a commercial agent or debt recovery service, whether such costs are incurred before or after the commencement of any legal proceedings. Indemnity and Inconsistency – The Customer agrees to indemnify Customs Brokers Pty Ltd against any claims or demands made against them arising from any declarations made on our behalf. Any inconsistency between trading terms and conditions, a service agreement, credit application or fee shall be considered in this order unless explicitly outlined in another agreement. Confirmation and Understanding Acknowledgment – The Customer has read, understand and accepts our Trading Terms and Conditions Confirmation and Understanding Acknowledgment – The Customer acknowledges that all documents relating to customs clearances, imports and export and related matters are required to be kept for a minimum of 5 years and presented to the relevant authorities on request. The Customer understands all the requirements and acknowledge and accepts the trading terms and conditions of Customs Brokers Pty Ltd and their service providers. The Customer understand that debt recovery action will be taken for unpaid costs and they will also be liable to cover any costs incurred in debt recovery.
