Authority to Act for Customs Clearance Purposes

The Customs Act 1901 (the Act) provides details as to the requirement of using a customs broker licensed by the Chief Executive Officer (CEO) of Customs to submit an import declaration to import goods.
Because of the complexity of the laws governing the importation of goods into Australia (similar to those of most other countries) and the potential financial and other implications of lodging an incorrect entry, most importers of goods choose to engage or allow, either explicitly or implicitly, a licensed customs broker to act on their behalf. This Authority to Act advises the client of the obligations of the licensed customs brokerage and their own obligations regarding importing goods into Australia.
It should be reviewed in conjunction with the customs brokerages terms and conditions as well as legislative requirements as/where applicable.

1. CUSTOMS CLEARANCE AUTHORISATION AND ACKNOWLEDGEMENT OF TERMS AND CONDITIONS*

1.1 The customer named below (Customer) agrees that all services provided by RIGEL 7 HOLDINGS PTY LTD (T/A CARGO CLEAR INTERNATIONAL (ABN 42663713166) its nominees and/or its agents (the Company) are subject to the Company’s standard terms and conditions of trade, as amended, varied or replaced from time to time (T&Cs).

2. TERM OF AUTHORITY*

2.1 This Authority will apply from the date of this Authority until terminated by either party.

2.2 This Authority is terminated by giving the other party written notice of termination.

3. AUTHORITY*

3.1 The Customer authorises the Company to act as the Customer’s agent and appoint Customs Brokers Pty Ltd, a licensed customs broker, on behalf of the Customer (Customs Brokers Pty Ltd ABN 63 636 237 682).

3.2 The Customer authorises the Company and/or the Customs Brokers to;

(a) quote the Customer’s Australian Business Number stated below as may be required to perform services on behalf of the Customer;

(b) act on the Customer’s behalf for all purposes contemplated by any Customs-related law (as defined in the Customs Act 1901) and for any purpose required to assist with import, export, carriage, storage, treatment and delivery of goods; and

(c) act on behalf of the Customer do all things requested by any government authority, department or body, related to the clearance, carriage and delivery of the goods.

4. AUTHORITY OF SIGNATORY*

4.1 The authorised signatory whose name is set out below (Authorised Signatory) warrants that it either is the Customer or has the express written authority of the Customer to enter into this Authority on the Customer’s behalf.

5. LIABILITY*

5.1 If the Authorised Signatory is not the Customer or does not have the authority to enter into this Authority on the Customer’s behalf, the Authorised Signatory agrees and acknowledges that it will be taken to have entered into this Authority on its own behalf and will be treated as the Customer under the T&Cs.

6. CONFIRMATION AND UNDERSTANDING ACKNOWLEDGEMENT*

6.1 The Customer has read, understand and accepts Cargo Clear International Pty Ltd Trading Terms and Conditions

6.2 The Customer has read, understand and accepts Customs Brokers Pty Ltd Trading Terms and Conditions

6.3 The Customer acknowledges that all documents relating to customs clearances, imports and export and related matters are required to be kept for a minimum of 5 years and presented to the relevant authorities on request.

7. INDEMNITY AND INCONSISTENCY*

7.1 The Customer agrees to indemnify Customs Brokers Pty Ltd against any claims or demands made against them arising from any declarations made on our behalf. Any inconsistency between trading terms and conditions, a service agreement, credit application or fee shall be considered in this order unless explicitly outlined in another agreement.

8. DEBT RECOVERY COSTS*

8.1 The Customer shall be liable to the Company and their appointed agent or customs broker for all costs and expenses incurred in the recovery of any unpaid debt, including but not limited to legal fees, solicitor’s costs on a full indemnity basis, and any fees or commissions payable to a commercial agent or debt recovery service, whether such costs are incurred before or after the commencement of any legal proceedings.

I have a scanned copy of my drivers license and/or passport for the clearance of my goods.

I have completed a detailed packing list of ALL the goods in the consignment. Including estimated values for the goods. Including any restricted or prohibited items.

My goods have been personally owned and used overseas by me for a specified length of time. Generally, this is the 12 months before my departure for Australia. My ownership duration is noted on my B534E form.

I have provided details of any goods that are not personal effects so they can be claimed as commercial goods.
